    2. When placing an order for curbside or in-store pickup, you agree to collect your order within the timeframe specified by the retailer. Failure to collect your order within the specified timeframe may result in the order being cancelled and a refund issued at the retailer's discretion.
    3. We are not responsible for delays or issues arising from the retailer's fulfillment process, including but not limited to product availability, substitutions, or pickup scheduling conflicts.
    4. Real-time inventory information is provided through our POS Integration. While we strive to maintain accurate inventory data, we do not guarantee that quantities displayed on the site reflect real-time availability at all times.

  7. ACCOUNT & BILLING

    1. You agree to provide current, complete, and accurate account information when creating an account with our store. You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.
    2. We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order.     2. We are not liable for any losses, damages, or inconveniences arising from temporary discrepancies between POS data and online storefront data, including but not limited to pricing differences, inventory inaccuracies, or delayed updates.
    3. Retailers are responsible for ensuring the accuracy of product data, pricing, and inventory information within their POS systems. We do not independently verify the accuracy of POS-sourced data.

  9. ARTIFICIAL INTELLIGENCE & AUTOMATED FEATURES

    1. Our platform utilizes Artificial Intelligence ("AI") to enhance customer and store experiences, including but not limited to product image matching, product recommendations, search optimization, and content personalization.
    2. AI-generated content, recommendations, and product matches are provided for informational and convenience purposes only. We do not guarantee the accuracy, completeness, or suitability of any AI-generated output.
    3. You acknowledge that AI features may evolve over time and that we reserve the right to modify, update, or discontinue any AI-powered functionality at any time without notice.
    4. We are not liable for any decisions made or actions taken based on AI-generated content or recommendations provided through our platform.

  10. B2B ECOMMERCE

    1. Certain features of our platform are designed for business-to-business ("B2B") transactions, including bulk ordering, specialized pricing, and account management. Access to B2B features may require a separate application or approval process.
    2. B2B pricing, payment terms, and order minimums are subject to individual agreements between Brinkmann's Blue Point (or the applicable retailer) and the B2B customer. Standard consumer terms apply unless a separate B2B agreement is in effect.

You agree to indemnify, defend, and hold harmless Brinkmann's Blue Point and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

  17. SEVERABILITY
